During this period of more virtual boom, and taking into account that people want maximum flexibility and security with their money, we are willing to do everything possible so that you can book with confidence. Our deposit rates are low and refundable, and we are very flexible with respect to final payment dates, which we evaluate on a case-by-case basis. Of course, we advocate getting insurance coverage as soon as possible after booking (and all travel insurers are offering 'greedy terms'). Even so, in case of cancellation, we will postpone the trip or proceed to process your refund. We want to assure our clients that any amount cancelled to the company for a trip is held in the client's account and is not touched until the trip takes place.

SECTION 1. ACCEPTANCE AND UNDERSTANDING

Before using the site www.thehubtravel.com please read the Terms and Conditions carefully. The use of our platform and associated technologies is conditional on the customer's acceptance of these terms, so you must make it clear if you agree by checking the box where you accept everything stated in the Terms and Conditions.

GENERAL SECTION 2.

2.1 It is understood that www.thehubtravel.com is property of The Hub Travel with legal domicile in Panama, Corregimiento Bella Vista, Urb. Obarrio, 51 East Manuel Maria Icaza Street, Magna Corp Building, 6th Floor, Office 601, duly registered before the pertinent authorities in the country.

2.2 A "customer" is a person who uses the portal through the portal. www.thehubtravel.com our airline ticket purchase services, car rental, national or international hotel reservations to any of our destinations, or through any of our offers and promotions.

2.3 "Portal" or "website" refers to the address www.thehubtravel.com and in case of mentioning another portal, this shall be duly specified.

2.4 "Supplier" means airlines, hotels, rent-a-cars, software providers, tour operators and other entities providing services to The Hub Travel and its customers on the Website.

2.5 Prices and Currency. The prices that appear on our web site are expressed in U.S. dollars and, in some occasions, in colones.

2.6 Immigration requirements. You must verify that your passport is valid for more than six months before your departure date. If you are traveling with a minor, you must corroborate the permission to leave the country. In addition, you must ensure that you comply with the visa and/or the respective vaccinations according to the destination.

2.7 Fares. After confirming the purchase of the air tickets, if you wish to make the payment of the same, this will be within a maximum period of 24 hours to guarantee the space and the fare. If the respective payment is not made within the stipulated time, a new quotation must be made, which implies possible changes in price and itinerary.

2.8 Fares are non-refundable / non-endorsable. The quoted fare is guaranteed once the ticket is issued. Fares are subject to change without notice. Once the ticket is issued, no name or routing changes are permitted.

2.9 Cancellation fees or penalties on airline tickets. Penalties apply for changes and cancellations after the ticket has been issued. These vary according to the specific conditions of the fare and the airline.

2.10 In the case of airline tickets, we remind you that, according to airline reservation policies, it is not allowed to book and cancel the same flight more than three times. Nowadays, this is considered an improper practice. In case of incurring in the same, a charge ranging from $30 USD to $75 USD on average will be applied, which will be passed on to you or your representative.

2.11 Other inclusions. Transportation, general admissions, guided or self-guided visits, tours, cruises and other complementary services are only included when expressed in the programs. Anything not expressly included in the respective programs is excluded.

2.12 Personal expenses. Expenses of a personal nature of the clients/passengers, such as telephone calls, laundry, tips, services requested in the room, optional tours, beverages, etc. are not included and shall be at their own expense and contracted at their own responsibility.

2.13 Baggage. On domestic flights, there is a small baggage allowance. Excess baggage charges are the sole responsibility of the customers/passengers. Please refer to the information provided by the airline and/or the operator with whom you have contracted air transportation services regarding the amount of baggage allowance and additional costs for excess weight and/or number of packages.

2.14 Exit or entry taxes (departure or boarding taxes). The programs exclude international and/or domestic departure or entry taxes. International departure or entry tax must be paid before proceeding with immigration and customs procedures. Please check current rates with the operator with whom you are contracting international and/or domestic transportation services.

SECTION 3. USE AND SCOPE

www.thehubtravel.com is a regional travel portal owned by The Hub Travel. It offers airline reservations, domestic and international hotels, and customized car rentals, as well as promotions and offers through its multiple agreements with travel suppliers around the world. It is an intermediary of operations and services between clients and suppliers.

The site provides customers with personalized services through relevant content according to their profile, which they can also register to receive promotions even closer to their interests.

In this portal you will be able to make your purchase securely. The offer and provision of these services are subject to the Special Terms and Conditions of the suppliers and by agreeing to the Terms and Conditions of the portal of www.thehubtravel.comIn the same way, the customer is accepting the Special Terms and Conditions. This should be consulted on the page of each supplier or by contacting our agents in the Contact Us section.

www.thehubtravel.com is committed to provide the best service through its website, however, it is not responsible for any damage or virus that may affect any customer's equipment, either by extraction, downloading or copying of information, image or sound. In the same way, no supplier will be responsible for this same effect.

The customer is responsible for the activities on the website, while taking care of their data, keys and passwords, to prevent misuse by third parties, their personal accounts. In case of fraud or theft of information, it is the customer's responsibility for the activity that results in fraud or loss of information. In the same way, www.thehubtravel.com may refuse access to any of the services offered by the portal.

SECTION 4. CONDITIONS AT THE TIME OF BOOKING

To reserve

Consult with the advisor for payment, cancellation, refund and penalty policies at the time of booking.

Tour plan reservations can be requested at your travel agency through our website www.thehubtravel.com or directly at The Hub Travel offices. Online reservations only apply until at least 20 days prior to travel. For reservations less than 19 days prior to travel, you must contact The Hub Travel directly. Rates subject to change at time of booking. Reservations are guaranteed only with full payment of the package. In case of force majeure or fortuitous event before or during the trip (accidents, strikes, over sales, earthquakes, climatic factors, security conditions, political factors, denial of entry permits, health issues, among others), or simply in order to ensure the success of the plan, the operator and/or the agency may modify, replace or cancel itineraries, dates, flights, hotels, optional services, which is now accepted by the passenger at the time of acquiring the services. The Hub Travel may inform the passenger the restrictions established by the airlines in terms of prohibitions, maximum weight and number of pieces per passenger, people allowed in the attractions or tourist sites, limitations or impediments of access by maximum quota. However, it shall be the sole responsibility of the passenger to comply with such policies, which may vary by provision of the transportation companies or the service provider. All additional information regarding validity, conditions, departure and foreign taxes, fees, charges and other mandatory payments, preventive health measures of the destination, assistance services should be consulted with the travel consultant at the time of booking. In the same way, this information will be given to the passenger in the travel documents, according to the characteristics that apply to each one, understanding that The Hub Travel has the appropriate information of the passengers, meaning: copy of passports and other necessary information, as appropriate. Tour packages are booked in specific and previously assigned classes. Quotas are limited. Tourist plans are not endorsable, refundable or transferable for any reason. Changes and/or cancellations of services once confirmed are subject to penalties. The passenger who, for any reason, be it necessity, negligence, illness, or simply not being on the described schedule and not taking any service, will not be entitled to any reimbursement. The organizer reserves the right to change itineraries, substitute hotels, travel dates and other services in order to provide for the success of the Tour. Other restrictions may apply.

Our prices do not include

Depending on the description of the content of the packages, or tours, they may not include airline and airport ticket taxes, gasoline and security "Qs" where not specified; visa and passport fees, excess baggage, tips, extras of any kind in hotels and cruises, transfers and hotel nights where not specified, airline tickets where not specified, telephone calls, Internet (in some cases), mini bar, room service, laundry, personal expenses and anything not specified in the tour packages. On cruises, in addition, gratuities (mandatory), port taxes, beverages and land excursions may not be included. For group bookings, gratuities are prepaid at THE HUB TRAVEL.

Payments

Our website receives as a form of payment deposits in bank accounts of institutions located in Costa Rica. The hours to receive bank deposits for airline tickets, cruises and reservations in general are from 9:00 am to 5:00 pm from Monday to Friday and from 9:00 am to 11:00 am on Saturdays, Costa Rican time (not applicable on holidays). The following forms of payment are accepted in our office: cash, certified checks made out to THE HUB TRAVEL and credit cards (Visa, Master Card and American Express). It is recommended to make the bank deposit in cash. Reservations are guaranteed only when payment is verified with the bank. If the bank deposit was made by check, the reservation will be confirmed when the check clears the bank. Until the check clears, the reservation or rate is not guaranteed and there is a risk of cancellation of the reservation without responsibility of The Hub Travel. The information provided must be the same as that which is on file with your financial institution (identity card, first and last names, address and e-mail, telephone numbers). On the date of purchase, the current rates and taxes and fees applicable at that time will be applied. Tour packages, cruises, trains and tours in Europe, Asia, Oceania and Africa: all passengers, including 3rd, 4th and children, must pay the deposit established for each case at the time of booking. The deadline for final payment may differ depending on the package purchased and the departure date. In the case of airline tickets, they must be paid in full at the time of booking. Otherwise, there is no guarantee of space or price. The administrative fee and handling charges charged on our website are not refundable in any case. In case of any inconsistency in payments, your reservation may be cancelled.

Cruises

Cruise prices are per person, minimum 2, traveling together and sharing the same double inside/outside cabin at the most economical price available at the time packages or promotions are published. The Cruises reserve the right to change, advance, postpone or cancel promotions, itineraries and ships or substitute any scheduled cruise without prior notice due to strikes, wars, occupations, riots, over sales, charters, weather conditions, natural disasters, mechanical difficulties or any other inconvenience. The cruises will not be responsible for non-compliance with the published arrival and departure times for any of the published ports and thus generating losses in air connections. The Cancellation Insurance offered by some cruise lines is optional and takes from 3 to 8 months to process claims and reimbursements, after presenting all the necessary proofs for the same. Cancellation insurance must be paid in full at the time the cruise is booked. Restrictions apply for refunds, please consult. The refund will be issued to the passenger, minus the cost of insurance and processing fees. The Hub Travel is an intermediary between the cruise line, and the insurance they offer, and the clients. It does not assume responsibility for any problems or delays that may arise with the insurance company. Special conditions may apply for seniors over 65 years old, please consult. No refund will be made if the passenger does not show up for the cruise and no refund will be made if the passenger interrupts or cancels the cruise once it has started and if he/she shows up at the port with an expired passport or without the required visas. All name substitutions and changes in cruise departure dates once the reservation has been confirmed and paid for will be considered cancellations. Depending on the cruise cancellation dates, charges established by the cruise lines in addition to those of The Hub Travel will apply. Reservations that have not been paid in full prior to the final payment deadline will be subject to cancellation. If reservations that were not paid on the established dates are cancelled, the same price is not guaranteed when rebooking and those reservations that were already in the penalty period are not refundable for any reason. Gratuities on cruises are mandatory and can be prepaid at The Hub Travel. It is recommended to book restaurants, shows and tours as soon as the full payment of the cruise is completed. These conditions are subject to change without notice. General conditions, payment policies, changes or cancellations for individuals or groups can be found on the web pages of each cruise line and in their respective manuals.

Service vouchers

Service vouchers are not valid if presented with erasures or amendments. The passenger must present the service vouchers to the contracted suppliers as proof of payment. The Hub Travel declines all responsibility if the contracted services are not provided because the passenger fails to deliver them on time.

Travel Assistance Insurance

It is the responsibility of all passengers to travel with travel assistance insurance for any eventuality that may occur during the trip. The insurance company is responsible for providing assistance abroad in the event of lost luggage, illness, sudden death, legal assistance, trip interruption and more. The Hub Travel declines all responsibility for any problems that may occur to passengers abroad because they have declined to purchase travel insurance. The Travel Assistance Insurance will provide assistance in the event of a sudden onset of an illness or injury, which affects or prevents the normal continuation of the trip, to the holder of the Assistance Insurance voucher; it does not apply to pre-existing illnesses; the holder may request assistance by contacting the telephone numbers indicated on the card and providing the holder's personal information. The assistance insurance company will proceed to give instructions, assistance and the corresponding authorizations, if required by the case. When due to duly justified emergency circumstances, the coverage holder is unable to call the Assistance Insurance and must resort to other physicians, the Assistance Insurance will reimburse the expenses incurred in these circumstances under the following conditions: to be entitled to this reimbursement the holder must communicate to the Assistance Insurance, by himself or through a third party, within 24 hours of the occurrence of the event, the information on the emergency suffered, the assistance received and the expenses incurred up to that moment. The reimbursement of these expenses shall be previously authorized by the medical department of the assistance insurance, which shall request all pertinent original documentation evidencing the receipt and origin of the service and/or purchase of the prescription drugs for which reimbursement is requested. In no case shall assistance or reimbursement be made unless all the above mentioned requirements have been met. The total amount of expenses and assistance will depend on the product purchased. Traveler's assistance insurance reserves the right to change assistance conditions, policies, general conditions and others without prior notice. Additional information is available at the time of purchase.

Passports and visas

It is the responsibility of each passenger to travel with a valid passport and equipped with all the necessary visas and requirements. In case a visa is required, The Hub Travel will provide advice on the case, being of the exclusive autonomy of the consular authority, all matters relating to the process, the documents requested, the study, costs, duration of the process and the approval or rejection. In case of visa refusal, there will be no reimbursement of the amounts paid by the applicant. Likewise, it will be the sole responsibility of the passenger to process and comply with the requirements reported. The Hub Travel must be informed by the clients the nationality of the passengers by means of a copy of the passport, indispensable to make the reservations. It is necessary that, when requesting quotes or reservations and before paying, passengers present their passports at The Hub Travel for our staff to verify expiration date and nationality. In this way we verify if the passengers require a visa for the requested destination. Failure to present passports The Hub Travel declines all responsibility for passengers being rejected by any authority in a country, for lack of any of the requirements that are needed or defect in the passport, and will be borne by the passenger any expenses incurred. Passports must be valid for at least 6 months before the trip in order to be able to leave the country. This is an international measure and applies to any destination. Yellow fever vaccine is required for some destinations and measles vaccine is recommended for the United States.

Conditions for group reservations

To guarantee group reservations an initial deposit per person is required, which will be established at the time of confirmations. This will be subtracted from the final payment. The deposit is non-refundable if the group does not travel and cancels the reservation. The confirmations will establish the dates of payments and final payments, which must be respected to the letter by the passengers. With the confirmations will be established the dates of delivery of names, changes thereof, the policy of changes and / or cancellations depending on the airline, hotel, cruises, tourist services and other contracted entities, in addition to the penalties that are generated by changes. Special specifications for the group must be provided at the time of the group reservation request (meals, language of the guides, special visits, etc.). The quotations given are based on the initial number of passengers; if the number of people in the group changes, a new quotation must be given and the previous prices will no longer be valid. The above also applies to changes of dates. Refunds once the services have been paid are subject to the policy of each entity involved. In some cases there will be no refunds for any reason. The Hub Travel reserves the right to cancel reservations that are not paid within the term established in the confirmation form or group contract.

SECTION 5. CANCELLATIONS AND RESERVATION CHANGES

Refunds on all reservations and payments made with The Hub Travel, by any means, are subject to the following:

5.1 Reservations and payments

A deposit of 20% of the total price will be required to confirm your reservation. The final balance must be received by The Hub Travel within 35 days prior to the date of arrival at the departure point of your trip. If payment of the final balance is not received by the stated deadline, The Hub Travel reserves the right to cancel reservations. Reservations made less than 35 days prior to the date of arrival at the departure point of your trip must be paid in full prior to the date of arrival.

You can pay by credit card (Visa or Master Card) or by bank transfer.

Credit card payments are subject to a 2.5% surcharge.

Payments made by bank transfer have no surcharge. The Hub Travel will take as payment for the contracted services the amount actually credited to your bank account free of transfer fees charged by the issuing and correspondent banks. Any difference that may arise will be the responsibility of the client to settle it through the available means of payment.

5.2 Modifications to reserves

In the event of a request to modify a confirmed reservation, The Hub Travel reserves the right to apply a minimum charge of $50 USD (fifty US dollars) for administrative expenses.

5.3 Cancellations

In the event that you need to cancel a confirmed reservation more than 35 days prior to the arrival date, you will be entitled to a refund of the amount paid less a cancellation fee of $250 USD (two hundred and fifty US dollars). If you have paid less than $250, there will be no refund.

In the event that you need to cancel a confirmed reservation between 34 and 21 days prior to the arrival date, the cancellation fee will be the equivalent of 25% of the total price of the contracted services.

In the event that you need to cancel a confirmed reservation between 20 and 10 days prior to the arrival date, the cancellation fee will be equivalent to 50% of the total price of the contracted services.

In the event that you need to cancel a confirmed reservation less than 9 days prior to the arrival date, the cancellation fee will be equivalent to 100% of the value of the contracted services.

5.4 Refunds

Those activities and excursions booked by The Hub Travel as part of the contracted services that could not be carried out due to weather conditions will be refunded in full.

This refund does not apply to cancellations due to force majeure (war, terrorism, state of siege, natural or nuclear disasters, epidemics, quarantine, customs or medical regulations, fire, labor disputes or strikes, etc.).

In the case of contracting travel programs, there shall be no right to reimbursement for services included and/or contracted, but not used during the program by decision of the clients/passengers, such as lodging expenses, car rental, excursions, etc.

SECTION 6. NOTIFICATIONS

Once the customer has made a reservation, he/she will be notified of the confirmation of his/her reservation to the e-mail address indicated in the process.

It will be the client's responsibility not only to provide www.thehubtravel.com with the appropriate information, but also to have the required documentation for the trip: visas, airport taxes, permission for minors and other pertinent information to complete the trip.

In the same way, in the case of having booked an airline ticket, it will also be the customer's responsibility to confirm it, both ways.

6.1 Notification of price changes

All prices are subject to change and variation. In the event of any fluctuation in prices, rates, taxes or any other element that affects part or all of the price of the contracted services The Hub Travel undertakes to notify you of such variation or fluctuation as far in advance as possible.

 

The changes and/or variations of prices originated by the causes indicated in the previous paragraph must be paid by the clients/passengers before the beginning of the contracted services.

6.2 Modifications and cancellations

Due to the fact that reservations are generally made well in advance, it may be necessary to make variations or modifications in the contracted services. In such case, you will be notified of such changes in price, route, itinerary, hotel, transportation, etc., if such variation or modification generates any inconvenience that makes it impossible to use the contract.

6.3 Reporting problems and inconveniences

If any problem or inconvenience arises during your trip, it is very important that you inform us immediately so that we can assist you in resolving it and minimize any possible adverse effects. If for any reason you are unable to inform us of the problem, please inform us in writing within 30 days of your arrival in your country, providing as much information as you consider relevant. If possible, we will assist you in any way we can to find a solution to the problem.

6.4 Notification of special needs

The Hub Travel undertakes to make every effort to meet any special requirements (e.g. special diets, persons with special needs, etc.) and to inform suppliers of your request when you make your reservation. It is important that you inform us of these special requirements in detail and as far in advance as possible.

SECTION 7. WEB SITE

The information contained in our website is basically informative and illustrative of the services we offer, and may eventually contain unintentional errors or omissions arising during the loading of such information. The Hub Travel is not responsible for such errors, omissions or failure to update such information.

SECTION 8. INTELLECTUAL PROPERTY

All right, title and interest in and to The Hub Travel, including any and all copyrightable materials or any other content therein that is or may be copyrighted under any applicable law (including art, graphics, images, photographs, videos, website templates and widgets, literary works, source and object code, computer code, including html), applications, audio, music, video and other media, designs, animations, interfaces, documentation, derivatives and versions thereof, the "look and feel" of The Hub Travel's methods, products, algorithms, data, features and interactive objects, advertising and acquisition tools and methods, inventions, trade secrets, logos, domains, custom URLs, trademarks, service marks, trade names and other proprietary identifiers, whether or not registered or registrable (collectively, "Intellectual Property"), and any derivatives thereof, are owned or licensed by The Hub Travel).

The Hub Travel Terms do not convey any right or interest in the Travel Agency's Intellectual Property (or any part thereof). Nothing in The Hub Travel Terms constitutes an assignment or waiver of the agency's Intellectual Property rights under any law.

SECTION 9. USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If, at our request, you send certain specific submissions (e.g., contest entries) or if, without our request, you send creative ideas, suggestions, proposals, plans, tours or other materials, whether online, by email, by postal mail or otherwise (collectively, "comments"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments you send to us. We are not and will not be obligated (1) to keep any Comments secret; (2) to pay compensation for any Comments; or (3) to respond to any Comments.

We may, but have no obligation to, monitor, edit or remove content that we determine, in our sole discretion, to be unlawful, offensive, threatening, libelous, defamatory, defamatory, pornographic, obscene or otherwise objectionable, or that violates any party's intellectual property or these Terms of Service.

You agree that your comments will not violate any third party rights, including copyright, trademark, privacy, personality or any other personal or proprietary rights. You further agree that your comments will not contain defamatory or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that may in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or any third party as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party.

The submission of personal information (including, but not limited to, names, surnames, identity numbers and nationality of the customer(s), e-mail addresses, telephone numbers, home addresses, etc.) through the website is governed by our Privacy Policy.

SECTION 11. ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our website that contains typographical errors, inaccuracies or omissions that may relate to tour descriptions, pricing, promotions, offers, travel times, tour schedules and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update or cancel information, if any information on the service or any related website is inaccurate at any time without notice.

We undertake no obligation to update, modify or clarify any information on the service or any related website, including but not limited to pricing information, except as required by law. No update or refresh date specified as applicable on the service or any related website should be taken as an indication that all information on the service or any related website has been changed or updated.

SECTION 12. PROHIBITED USES

In addition to the other prohibitions set forth in the TOS, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful act; (c) to violate any local international, federal, provincial or state regulation, rule, law or ordinance; (d) to infringe or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, libel, slander, disparage, intimidate or discriminate on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other malicious code that will or may be used in any manner that affects the functionality or operation of the Service or any related website, other websites or the Internet; (h) to collect or track the personal information of others; (i) to send spam, phish, pharm, pretexts, spiders, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites or the Internet. We do not warrant, represent or guarantee that your use of our travel agency service will be uninterrupted, timely or error-free.

You agree that, from time to time, we may remove tours or visits for indefinite periods of time or cancel them at any time, without notice.

You expressly agree that your use of or inability to use the travel agency service is at your sole risk. The service provided (unless expressly stated by us) is "as is" and "as available" for your use and enjoyment, without any representation, warranty or condition of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality and fitness.

In no event shall The Hub Travel, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including, without limitation: loss of profits, loss of revenue, loss of savings, loss of data, replacement costs or any other similar damages, whether based in contract, tort (including negligence), strict liability or otherwise arising out of your use of any of the travel agency services or tours purchased through the service, or for any other claim related in any way to your use of the service, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of the service posted, transmitted or otherwise made available through the service. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

13.1 Responsibility and Scope

This website is the property of The Hub Travel, which will make every effort to properly manage and arrange reservations of programs, tours and other services offered on the site. The images shown on the site are included for illustrative purposes only and may not, in all cases, match the locations included in the programs.

The travel agency is not responsible for the consequences of any improper or negligent acts, omissions, or failure of one or more of the services managed by its suppliers, such as transportation, hotels, cruises, or any other activity and/or service not directly owned or controlled by The Hub Travel.

The Hub Travel will not be liable in any way for any loss, injury, death or damage to persons and/or property caused directly or indirectly by accidents related to meteorological causes, earthquakes, tsunamis, fires, machinery or equipment breakdowns, acts of government or other authorities, declared or undeclared wars, strikes, riots, thefts, epidemics, quarantines, medical or customs regulations, terrorist activities or any other action, omission or condition beyond our control. Neither the travel agency nor its associates shall be liable for any additional expenses or charges arising from the liability and/or negligence of the clients/passengers contracting the services offered, or as a result of the aforementioned causes.

The Hub Travel shall not be liable for any loss, injury, death or damage to persons and/or property, nor for accidents that may occur while using any of the services offered by the travel agency and/or its suppliers.

13.2 Independent Contracts

Any contracts or agreements that clients/passengers initiate independently are their sole responsibility and liability. The Hub Travel will not assume any liability or reimbursement with respect to these contracts.

SECTION 14. INDEMNIFICATION

You agree to indemnify, defend and hold harmless The Hub Travel, our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15. DIVISIBILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the maximum extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service, such determination shall not affect the validity and enforceability of the remaining provisions.

SECTION 16. TERMINATION

The obligations and liabilities of the parties incurred prior to the date of termination shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our travel agency services, or when you stop using our site.

If in our judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these terms of service, we may also terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our services (or any part thereof).

SECTION 17. COMPLETE AGREEMENT

Our failure to exercise or enforce any right or provision of these terms of service shall not constitute a waiver of such right or provision.

These TOS and any policies or operating rules we post on this site or in connection with the Service constitute the entire agreement and understanding between you and us, and govern your use of the travel agency service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, without limitation, any prior versions of the TOS).

Any ambiguity in the interpretation of these terms of service shall not be construed against the party that drafted them.

SECTION 18. APPLICABLE LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Costa Rica.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes on our website.
